The 14th Amendment was a result of slavery. Section 1 provides: “All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the States wherein they reside...” People may today wonder why that clause is needed. 1/5

In 1856 SCOTUS held: “A free negro of the African race, whose ancestors were brought to this country and sold as slaves, is not a ‘citizen’ within the meaning of the Constitution of the United States. () When the Constitution was adopted, they were not regarded in any of the States 2/5

as members of the community which constituted the State, and were not numbered among its "people or citizens." Consequently, the special rights and immunities guarantied to citizens do not apply to them.” Dred Scott v. Sandford, 60 U.S. 393 (1856). SCOTUS made birth 3/5

on this soil a basis for rights and looked at the status of slaves when the Const’n was adopted & proponents of orginalism need note. The 13th, 14th & 15th, or “Civil War”, amendments changed our gov’t, expanded protection of our rts & sought to right the many wrongs of slavery. 4/5
